The federal appeals court has upheld a ban on sending national guard in Portland, Oregon, following a latest court ruling.

Judicial Panel Concurs to Rehear Case

The ninth circuit court of appeals ruled on this week that it would rehear the case concerning the president’s authority with an expanded panel of 11 judges. The judicial body also overturned a previous decision from a three-judge panel that had sided with the federal government.

Ongoing Dispute Over Military Presence

This order represents the latest turn in a protracted legal battle over whether the former president has the authority and justification to deploy national guard forces in the city. Approximately 200 federalized guard members have been in uncertainty since the end of September when the deployment effort was initiated in response to ongoing demonstrations.

Differing Viewpoints

The federal government has claimed that government employees at the ICE facility in the southern part of the city were under attack, while local authorities assert that municipal police have control of the situation.

In defiance of characterizations of the city as “war ravaged”, residents have been sharing videos of scenic paths and a thriving food scene, and organizing events such as an Emergency Naked Bike Ride against the increased military presence.

Court Proceedings

The appeals court decision came after a US district judge in Portland issued two temporary restraining orders this period – one preventing the federal control of the Oregon national guard, and another prohibiting the deployment of any national guard troops in Oregon, after efforts to circumvent the initial injunction by calling up out-of-state forces.

On the previous day, the ninth circuit panel had temporarily suspended the initial decision – permitting control of state troops – but the subsequent injunction remained in place, preventing the physical sending of the troops.

Full Panel Consideration

The Tuesday decision means the matter will be heard “en banc” – with all decisions under review simultaneously – by a panel of eleven justices.

“This decision demonstrates that the truth matters and that the judicial system are working to ensure government responsibility. The constitution limits the president’s power, and Oregon’s communities cannot be treated as a training ground for expansive government power,” said the legal representative in a statement.

“The judicial body is sending a clear message: the executive leader cannot send the military into American urban areas without cause. We will continue protecting state legislation, values, and autonomy as this legal proceeding moves forward and our legal battle continues in the judicial system.”
